this news is published in Dainik bhaskar (shekhawati bhaskar) शिक्षा विभाग अभी तक शिक्षक भर्ती एवं पात्रता परीक्षा (रीट) की प्रक्रिया भी शुरू नहीं कर पाया है कि कानूनी पेचीदगियां आड़े आ गई हैं। दरअसल, नेशनल काउंसिल फोर टीचर एजुकेशन (एनसीटीई) की गाइडलाइन में रीट का प्रावधान ही नहीं है, ऐसे में चार लाख अभ्यर्थी निजी स्कूलों में 8वीं तक नहीं पढ़ा पाएंगे। 

एनसीटीई की गाइडलाइन के अनुसार, शिक्षण के लिए शिक्षक पात्रता परीक्षा (टेट) पास होना जरूरी है। ऐसे में रीट पास करने के बावजूद बिना टेट किए शिक्षकों को निजी स्क्ूलों में नौकरी नहीं मिल सकेगी। अब शिक्षा विभाग इस मामले में विधि विभाग की राय ले रहा है। सरकार ने 31 मई तक रीट की प्रक्रिया शुरू करने का एलान किया है।

जानकारों का कहना है कि यह भर्ती भी पिछली भर्तियों की तरह कोर्ट में अटक सकती है। प्रदेश के साढ़े ग्यारह लाख बीएड, बीएसटीसी डिग्रीधारियों को शिक्षक भर्ती एवं पात्रता परीक्षा (रीट) का पिछले 10 माह से इंतजार है। अफसरों का कहना है कि विधि विभाग से राय मांगी गई है, ताकि भर्ती किसी कानूनी पेंच में न फंसे और अभ्यर्थियों को समय पर नियुक्ति मिल सके। देश में शिक्षा का अधिकार कानून लागू होने के बाद पहली से आठवीं तक पढ़ाने के लिए टेट उत्तीर्ण होना जरूरी हो गया है।

सरकारी सेवा ही नहीं निजी स्कूल में पढ़ाने के लिए भी शिक्षक पात्रता का प्रमाण पत्र होना जरुरी है। प्रदेश में 2011 और 2012 में दो बार आरटेट का आयोजन हुआ। इसमें 7,50,218 बीएड या बीएसटीसी डिग्रीधारियों ने आरटेट की योग्यता प्राप्त कर ली। आरटेट उत्तीर्ण होने के बाद राजस्थान माध्यमिक शिक्षा बोर्ड की ओर से दिया गया शिक्षक पात्रता प्रमाण पत्र 7 साल के लिए वैध है। इनको भी भर्ती प्रक्रिया में शामिल होने के लिए रीट का आवेदन भरना होगा।

एनसीटीई की गाइडलाइन में स्कूलों में शिक्षक पात्रता प्रमाण पत्र रखने वालों को ही शिक्षक के रूप में रखने की अनिवार्यता है। निजी स्कूल में नौकरी के लिए अगर टेट की जगह रीट परीक्षा में उत्तीर्ण होने का प्रमाण पत्र पेश किया जाएगा वे एनसीटीई की गाइडलाइन के अनुसार काम करेंगे। - दामोदर गोयल, अध्यक्ष, सोसायटी फॉर अनएडेड प्राइवेट स्कूल्स

रीट की वैधानिकता पर सवाल

एडवोकेट संदीप कलवानिया का कहना है कि एक तो एनसीटीई की गाइडलाइन में रीट का उल्लेख नहीं है। दूसरा रीट का प्रमाण पत्र कितने समय तक वैध रहेगा, यह स्पष्ट नहीं है। साथ ही एनसीटीई की गाइडलाइन में टेट हर साल आयोजित कराने का प्रावधान है। क्या रीट भी हर साल होगी। अगर नहीं हुई तो गाइडलाइन का उल्लंघन होगा। ऐसे में रीट की वैधानिकता पर ही सवाल है।
